Privacy Policy – Your data is safe with us

Data protection is a matter of trust. Your trust is important to us. We respect your privacy. The protection and the collection, processing and use of your personal data in compliance with the law is therefore of great concern to us. We adhere strictly to legal regulations when processing your personal data, so you can feel safe when visiting our website. This Privacy Policy will inform you about our collection and use of data.


Purpose and Scope of Data Processing

1. Anonymous Data Collection
You may visit our website without disclosing personal information. We will merely save so-called “server log files,” access data without personal references, e.g., the name of your Internet service provider, your Internet browser, the page from which you are visiting us, the time and date of your access or the name of the requested file. This data will only be used to improve our offer and cannot be traced back to you.

This anonymous data is saved separately from any personal data you may provide and therefore cannot be used for personal identification. This data is assessed for statistical purposes to optimize our Internet presence and our offers. The legal basis for the temporary saving of this data and of the “server log files” is Art. 6(1) Letter f of the General Data Protection Regulation. Log files are saved to ensure the website’s functionality. This data is deleted when it is no longer required for achieving the aims for which it was collected. For data collected for website delivery purposes, this will apply when the respective session ends.

2. Collection and Processing Personal Data
Use of a service provided by our company through our website may require the processing of personal data. If there is no legal basis for the processing of personal data, we will obtain the data subject’s consent. This will be displayed where required, e.g., when you register on our website, request our newsletter or contact us through our contact form. The legal basis for processing for which we obtain your consent is Art. 6(1) Letter a of the General Data Protection Regulation. If the processing of personal data is required for contract fulfillment or initiation (e.g., for the delivery of goods, the performance of such services or inquiries about our products or services), processing will be performed on the basis of Art. 6(1) Letter b of the General Data Protection Regulation.

We will save and use personal data transmitted by you, such as your name, company, address, email address or telephone number, for individual communication with you in accordance with the General Data Protection Regulation (GDPR) and the New Version of the German Federal Data Protection Act [Bundesdatenschutzgesetz n.F., BDSG-neu]. Please note that confidential information should not be transmitted through the contact form.

The legal basis for the processing of data transmitted in the course of sending an email is Art. 6(1) Letter f of the General Data Protection Regulation. If we are contacted by email for the purposes of concluding a contract, an additional legal basis for processing will be Art. 6(1) Letter b of the General Data Protection Regulation.

3. Newsletter Subscription
Once you have expressly signed up for our newsletter, you will receive regular interesting offers by E-Mail. Your E-Mail address will not transfer to other companies. This consent to use your E-Mail address for advertising purposes can be revoked at any time with effect for the future by clicking on “unsubscribe” link at the bottom of our newsletter or at the member area.

By registering to our newsletter, we collect your IP address, the date and the time of your registration. This is for the purpose that a third party abused your email address and subscribe to our newsletter without your knowledge, as a hedge on our part. We will not collect more data. The collected data will be used exclusively for the subscription of our newsletter. No data will be transmitted to third parties. A comparison of the collected data with data that may be collected by other components of our site will also not be done. You can unsubscribe this newsletter at any time. For details, please refer to the confirmation email and each newsletter.

For the processing of the data, your consent is obtained during the registration process and reference is made to this privacy policy. The legal basis for the processing of the data after the user has registered for the newsletter is Art. 6 (1) lit. a GDPR.

The legal basis for sending the newsletter as a result of the sale of goods or services is Section 7 (3) „Act Against Unfair Competition“. The data will be deleted as soon as it is no longer necessary to achieve the purpose of its collection. Your e-mail address will therefore be saved as long as the subscription to the newsletter is active.

3.1. Sending Newsletters
The newsletter is sent via “Pardot” of the cloud provider Salesforce (sales-force.com Germany GmbH, Erika-Mann-Str. 31, 80636 München,, Germany). The service provider is used on our legitimate interests according to Art. 6 (1) lit. f GDPR and a contract processing agreement according to Art. 28 (3) sentence 1 GDPR. The data processing is based on your consent (“opt-in”) according to Art. 6 (1) lit. a GDPR. You can revoke this consent at any time by unsubscribing from the newsletter. The legality of the already completed data processing operations remains unaffected by the revocation.

The e-mail addresses of our newsletter recipients are stored on Salesforce servers. Salesforce uses this information to send and evaluate the newsletters on our behalf. In addition, Salesforce may use this information to optimize or improve its own services, e.g for the technical optimization of shipping and the presentation of newsletters or for statistical purposes, to determine from which countries the recipients come. The use of this data is in pseudonymous form, that means without assignment to a user. However, Salesforce does not use the data of our newsletter recipients to self-address or disclose to third parties.

4. Cookies
Among other things, our website uses so-called “cookies” that serve to make our Internet presence more user-friendly, effective and safe—e.g., by making it easier to navigate across our platform. Cookies also allow us to measure the frequency with which pages are opened and general navigation on our website. Cookies are small text files saved on your computer system. Please note that some of these cookies will be transferred onto your computer system from our server—usually so-called “session cookies.” “Session cookies” will be automatically deleted from your hard disk when your browser session ends. 5. Plugins

  • Cloudflare

On our website we use the performance and security service of Cloudflare Inc., 101 Townsend St., San Francisco, CA 94107. The legal basis is Art. 6 (1) lit. f GDPR. Our legitimate interest is the efficient and secure provision of our Internet offer.

Cloudflare optimizes the loading times of our website and its security. For this purpose we use Cloudflare as a „Content Delivery Network“ (CDN). A CDN is a network of regionally distributed servers connected via the Internet. The CDN provides scaling storage capacity and delivery capacity. As a result, optimum data throughput can be ensured even with large load peaks. Through Cloudflare, user requests on our website are first routed through Cloudflare servers in the United States. Statistics are generated from these data streams. This is to detect potential threats to our website by malware early and to optimize the loading times of our website.

We have entered into a contract processing agreement with Cloudflare, so Cloudflare is entitled and obliged to evaluate the information obtained and to provide us with statistical reports on the type and extent of website use. These statistics enable us to constantly improve our offer, to carry out a cost-benefit analysis of our Internet marketing and to make our website more interesting and user-friendly for you as a user.

  • On our website, we have linked to social media logos from Facebook, Twitter and LinkedIn (hereinafter referred to as the “provider”), which forward to our respective profiles deposited with the providers and enable you to follow us there.
    • Facebook is a service of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA. In the EU, this service is again operated by Facebook Ireland Limited, 4 Grand Canal Square, Dublin 2, Irland, hereinafter referred to as “Facebook”.

    • LinkedIn is a service provided by LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Irland.

For data protection reasons, we have only implemented a link to our respective profiles at the providers. This means that no data about you will be transferred to the providers, unless you click on the respective social media logo. However, once you click on our link to our profile, you will be redirected to the provider’s website, which will result in data being transmitted to the respective provider. We have no control to this, possibly personal, data transfer and data collection to / from the providers. In addition, we have no knowledge of the individual purposes of these data processing or their scope and storage duration. We also do not know – and is not in our sphere of influence – whether the providers make deletions, generate or allocate profiles or set anonymizations.

Insofar as you are simultaneously logged on to one of the aforementioned providers by activating the respective links implemented on our website, the data collected by the provider when you access its website are immediately assigned to your respective profile.

The processing of users’ personal data is carried out on the basis of our legitimate interests in providing users with effective information and the communication with users in accordance with Art. 6 (1) lit. f) GDPR.
If the users are asked by the respective providers to give their consent to the data processing (that means to declare their consent, e. g. by clicking the checkbox or confirming a button), the legal basis of the processing is Art. 6 (1) lit. a), Art. 7 GDPR.

  • Google Webfonts

For visually improved presentation of various information on this website, we use Google Fonts. This is a service provided by Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA.

To enable the display of certain fonts on our website, a connection to the Google server in the USA is established whenever our website is accessed. The legal basis is Art. 6 (1) lit. f) GDPR. Our legitimate interest is the optimization and economic operation of our site. When you access our site, a connection to Google is established from which Google can identify the site from which your request has been sent and to which IP address the fonts are being transmitted for display.

  • Pardot

We use on our website the service Pardot (Pardot Marketing Automation System), a marketing automation tool from salesforce.com EMEA Limited, Floor 26 Salesforce Tower, 110 Bishopgate EC2N 4AY London, UK. The legal basis is Art. 6 (1) lit. f) GDPR. Our legitimate interest is the optimization and economic operation of our site.

The “Pardot Marketing Automation System” is a special software for recording and evaluating the use of a website by website visitors. If processing of personal data is carried out by “salesforce.com EMEA Limited”, processing will be carried out exclusively on our behalf and in accordance with our instructions. For analysis, Pardot uses so-called cookies and stores them on the user’s computer. The data subject can prevent the setting of cookies through our website at any time by means of a corresponding setting of the Internet browser used and thus permanently contradict the setting of cookies. Furthermore, already set cookies can be deleted at any time via an internet browser or other software programs. This is possible in all popular Internet browsers. If the data subject deactivates the setting of cookies in the used Internet browser, not all functions of our website may be fully usable.

  • Google reCaptcha

In certain cases, we use on our website the service “reCap-tcha” of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. The legal basis is Art. 6 (1) lit. f GDPR. Our legitimate interest is the secure provision of our Internet offer. The query is used to distinguish whether the input is made by a natural person or abusive by automated, mechanical processing.

6. Publication of job Offers/Online Job Applications
For our application management we use “Softgarden”, an online service of softgarden e-recruiting GmbH, Tauentzienstraße 14, 10789 Berlin (hereinafter “softgarden”).

Softgarden is an online service where you can register as applicant and then provide us with your digital application. The data is stored and processed on the servers of Softgarden. The privacy policy and terms of use of Softgarden apply and can be found at www.softgarden.de/unternehmen/datenschutz/
We have entered into a contract processing agreement with Softgarden pursuant to Art. 28 (3) sentence 1 GDPR and we fully implement the strict requirements of the German data protection authorities when using Softgarden.

If you apply for a job online with us, we will store the personal data provided during the application process. This is done exclusivley to process your application. Only individuals who are involved in the application process and are required to maintain the confidentiality of your data will be aware of your personal data. A transfer of the data to third parties only takes place if you have consented to the disclosure or if we are obliged by law and / or official or judicial orders to a data transfer. The legal basis for this is Art. 88 (1) GDPR in accordance with Section 26 (1) sentence 1 “BDSG-neu”. Our legitimate interest results from finding an adequate applicants for the vacancy. If you willing-ly provide us with information about yourself beyond what is necessary in this process, this is done with your consent in accordance with Art. 6 (1) sentence 1 lit. a GDPR.

After completion of the concrete application process, your data will be automatically deleted within three months. A deletion does not take place, if legal regulations preclude a deletion, if further storage is required for evidence purposes, or if you have explicitly agreed to a longer storage. We also use softgarden as an application management system for unsolicited applications by entering the data into the system. With your application, you consent to this processing.

7. Data Subject Rights
Under the General Data Protection Regulation (GDPR), you have the right to access data saved regarding you, free of charge. Furthermore, you have the right to obtain information on the processing purposes, categories of personal data being processed, recipients or categories of recipients to whom personal data was or will be disclosed (especially regarding recipients in third countries or at international organizations), if possible, the scheduled storage duration of your personal data, the right to rectification, processing restriction (blocking) or erasure of this data and to learn the source of the data. In addition, you have the right to lodge a complaint to a competent supervisory authority. You also have the right to withdraw your consent at any time. However, withdrawal of consent will not affect the lawfulness of processing based on consent before its withdrawal.

8. Data Portability
You have the right to receive personal data obtained directly from you. On your express request, we will provide this data to you in a machine-readable and structured format. This will, however, require confirmation of your identity.

9. Data Security
We use TLS to safely transmit your encrypted data when using our contact forms. We use technical and organisational measures to protect our website and systems in order to keep unauthorised people from losing, destroying, accessing, changing or distributing your data.

10. Personal Data Deletion and Blocking
If it is no longer required for contract fulfillment or initiation, personal data will be deleted, subject to storage obligations under the law and/or fiscal codes, and blocked when the purposes for which it was collected cease to apply.

11. Contacting Us
You may contact us by email or via the contact form on our website. In this case, the information you provide for contacting us will be saved. Your consent to the processing will be obtained as part of the processing of the transmission and this Privacy Policy will be noted. Alternatively, you may contact us at the email address provided.

In this case, the user’s personal data, transmitted with the email, will be saved. Personal data from the input screen of our contact form is only processed to allow us to handle the inquiry. The same legitimate purposes for data processing also apply if we are contacted by email. Your data will not be transferred to third parties. Nor will the data collected this way be aligned with data that may have been collected through other components of our website. The legal basis for data processing with the user’s consent is Art. 6(1) Letter a of the General Data Protection Regulation. The legal basis for processing data that is transmitted to us with an email is Art. 6(1) Letter f of the General Data Protection Regulation. If we are contacted by email about the conclusion of a contract, Art. 6(1) Letter b of the General Data Protection Regulation will serve as an additional legal basis for processing.
